FDA Suspends Temporary Emergency Permit of Pet Food Maker

The U.S. Food and Drug Administration announced today it was suspending the temporary Emergency Permit issued to Evanger's Dog & Cat Food Co., Inc.

Evanger's, operating in Wheeling, Illinois, deviated from the prescribed process, equipment, product shipment, and recordkeeping requirements in the production of the company's thermally processed low acid canned food (LACF) products.  The deviations in their processes and documentation could result in under-processed pet foods, which can allow the survival and growth of Clostridium botulinum (C. botulinum), a bacterium that causes botulism in some animals as well as in humans.

In April 2008, Evanger’s was issued an “Order of Need for Emergency Permit” after the agency determined that the company had failed to meet the regulatory requirements to process a product that does not present a health risk.   In June, 2008, FDA issued Evanger’s a temporary Emergency Permit.  During inspections conducted between March 2009 and April 2009, FDA determined Evanger’s was not operating in compliance with the mandatory requirements and conditions of the Temporary Emergency Permit. 

“The FDA is stopping Evanger's ability to ship pet food in interstate commerce,” said Dr. Bernadette Dunham. “Today’s enforcement action sends a strong message to manufacturers of pet food that we will take whatever action necessary to keep unsafe products from reaching consumers.”

In order for Evanger's to resume shipping in interstate commerce, the company must document that corrective actions and processing procedures have been implemented to ensure that the finished product will not present a health hazard.

Botulism is a powerful toxin that affects the nervous system and can be fatal. The disease has been documented in dogs and cats. Signs of botulism in animals are progressive muscle paralysis, disturbed vision, difficulty in chewing and swallowing, and progressive weakness to the body. Death is usually due to paralysis of the heart or the muscles used in breathing.

While FDA’s Center for Food Safety and Applied Nutrition is responsible for regulating all human and animal LACF processing, FDA's Center for Veterinary Medicine has authority over animal feed and foods.  The two centers are collaborating on this enforcement action.

Evanger's Dog & Cat Food Company Responds To FDA News Release

As a result of a routine inspection of the Evanger's Dog & Cat Food Company manufacturing facilities by the U.S. Food and Drug Administration, the FDA recently raised questions regarding recordkeeping and other issues at the pet food producer's facilities.

Contrary to a news release issued by the FDA Thursday, April 24, 2008, Evanger's continues to make and distribute its products with FDA approval. Evanger's is working closely with the FDA and already has addressed many of the FDA's questions. Evanger's expects to have the few remaining FDA queries fully satisfied shortly.

No Evanger's product has been recalled, nor is there any indication that any Evanger's product is under-processed, unsafe, or contaminated in any way.

Communicating with Evangers as a potential pet owner (due to Petsumer Report reviews for July), I sent several emails to Evangers over the past two weeks (since the above little seen press release).  Interestingly, my email questions (for Petsumer Report) were answered by the Graphic Designer of Evangers.  That was a first for me.  The Graphic Designer attempted to allude my questions (quality of protein, quality control practices, ect) however, I insisted someone answer my questions.  Surprisingly (perhaps not now after this FDA shut down of Evangers shipping pet food), the Graphic Designer, not a pet food Customer Service Representative, answered my questions).

This is so bizarre! I was told the only real "beef" the FDA had with Evangers was their recordkeeping. Now this?

I clicked on both links and the documents/stories are gone. Hmmm....

Read the Evangers threads at www.itchmoforums.com .If they weren't so busy posting all over the web that the FDA was wrong & calling any customer with a complaint an extortionist[me],maybe they could produce a safe food !The OCI agent told me it isn't just paperwork. They are being criminally investigated also.

Unfortunately, I'm suspect of the FDA and their practices and wonder if it isn't a 'witch-hunt' to shut down a "natural food" company. It's happening more and more often.....in the natural supplement and natural foods arena. They are being targeted by pharmaceutical companies who fear the people may become too well informed and switch to more healthful practices.......for our pets as well. I'm not saying that this is the case here, because I don't know. Just saying we need to be aware of the possibility. The FDA and the pharmaceutical companies have been "bedfellows" for a long time!!! I agree with LeslieM, FDA is crooked as hell and is in bed with big pharma, they want you and your pets to be sick to peddle their drugs!!!! Now if the company was a cheap junk cat food company I would believe it. Glad more people are waking up...

In response to Susan, I have recently re-done my web site and included a link to your site. After reading your alarmist post about someone's email signature, I am second-guessing my decision to include your site as a quality reference for my customers. I have been selling Evanger's food for almost 5 years. Evanger's is a small company where many people wear many hats, so it means nothing to me that a "graphic designer" answered your questions. I have been to their plant and to their offices; everybody does everything there. If you are going to post about your email, I would suggest that you post the entire thing so we can decide for ourselves what transpired.
I believe that this was and remains a paperwork issue. I will call Holly Sher, owner of Evanger's, myself on Monday to find out what the details are. I have her mobile phone number if you would like it...I suggest you find out more information before "alerting" readers to items which may or may not be true.

It's not my job to keep pet food manufacturers happy. My job - volunteer job - is to tell pet owners what is going on as best I can. I did bother to post the Evangers response to the FDA - I didn't have to do that. I gave them the benefit of the doubt. As for a Graphic Designer responding to questions regarding their foods, I still find that highly unusual. "Alarmist post" - no, I don't think so. This was/is the FDA stopping a pet food company from shipping product because of a problem. If the problem is paperwork or if the problem is manufacturing - pet owners deserve to know about it either way.

Nobody suggested your job, volunteer at that, (i volunteer, too) was to keep anyone happy. And you do take pains in your reply to let us all know what a good reporter you are by giving them "the benefit of the doubt." All I'm suggesting is pick up the phone if you're unsure of what you're reporting. That's what I"m going to do.

I posted about the FDA suspending Evanger's license, and someone from Evanger's left a comment on my blog saying that they don't know where that info came from, that it's not true, and that I should not rely on "internet speculation".

I replied to them and on my blog again citing the link to the FDA site, and told this person that if they feel the information is untrue, to take it up with the FDA, but that everything I had posted was true.

I doubt it. My dog recently got severe diarrhea after eating Evanger's canned food, which he has been eating without problems for the last three years. And a friend of mine who fed it to her dogs with food allergies kept finding peices of plastic and corn kernels in the canned game meat foods, that were not supposed to contain any grains, let alone plastic. She called and complained and they sent her another case, that still had stuff in it that shouldn't be there, so she has stopped feeding it.

Test results are back from an unopened bag of Nutro Max Cat Adult Roasted Chicken Flavor, Best by: 07 JUN 2010 07:17 2AD6 "A". Zinc, as fed, came in at a deadly 2,100 parts per million. Using this food by Nutro recommended feeding guidelines, a pet eating this food would receive over 38 times the amount of zinc recommended by the National Research Council, or 175 mg. zinc a day.
